We at Sown To Grow, Inc. ("Sown To Grow," "we," "us," or "our") know that you care how information about you is used and shared, and we appreciate your trust that we will do so carefully and sensibly. This notice describes our privacy policy ("Privacy Policy").
This Privacy Policy does not govern the collection, use, or disclosure of personal information by an Institution through the Site or Service, as each capitalized term is defined in our Terms of Service ("Terms"), and we are not responsible for any such collection, use, or disclosure. Parents, please contact your Student's school or other applicable Institution to understand its privacy practices.
The provisions of our Terms apply to this Privacy Policy as well. All capitalized terms not elsewhere defined in this Privacy Policy shall have the same meaning ascribed to them in the Terms.
"You" or "your" refers to: (a) any individual accessing the Services, including, without limitation, Teachers, Students, Support Staff, and Administrators, (b) any Institution on whose behalf such individual is accessing the Services, and (c) any parent or legal guardian of a Student who is under the age of 18.
By accessing and using the Site and/or the Services, or by clicking the applicable button or checkbox to indicate your acceptance of this Privacy Policy and our Terms, to the extent made available to you, or by permitting your Student to do the foregoing, you consent to the privacy practices described in this Privacy Policy and agree that you are at least 13 years old.
Information You Voluntarily Provide.
Accounts.
We collect information that you voluntarily provide to us, directly or through your school or other Institution with whom we have an applicable Purchase Order or Contract, as part of the Account registration process or that you subsequently provide through your use of the Service. Such information may include, without limitation:
- First and last name, email address, and applicable grade level (s) (for all Users).
- Physical, mailing, and/or billing address and phone number (for Institutions).
Third-Party Sign-In Provider.
If you sign in to and access your Account through a third-party provider, such as Google or Clever, you are authorizing Sown To Grow to collect, store, and use, in accordance with this Privacy Policy, any and all information that you agreed that such provider would provide to Sown To Grow through its application programming interface. Such information may include, without limitation, your first and last name, email address, and information associated with such third party. In this Privacy Policy, we refer to information that, on its own or in combination with other information, may be used to identify individuals as "Personal Information."
Privacy of Students Under 13 Years of Age.
We strive to educate parents and Students about how to safeguard their privacy appropriately when using our Services. We are committed to complying with the Children's Online Privacy Protection Act of 1998 ("COPPA"), which aims to protect Students who are under the age of 13. We recommend that parents discuss with their Students restrictions regarding the online release of Personal Information to anyone they do not know. The Site and the Services are available to Students under the age of 13 only with Teacher supervision and parental consent provided to the applicable Institution that has an active Purchase Order or Contract with Sown To Grow.
Accordingly, we only collect Personal Information through the Services from a Student under the age of 13: (a) where we have provided that Student's school, district, and/or teacher with notice of our information practices, (b) where that Student's applicable Institution has provided consent on behalf of the Student for that Student to use the Services and disclose Personal Information to us, (c) where the Student is being provided access to our Services by an Institution that acknowledges that Sown To Grow is a "school official" under FERPA, and (d) solely for the educational context and not for advertising, marketing, or any other commercial purpose.
If you are a Student under the age of 13, please do not send any Personal Information other than what we request from you in connection with the Services. If we learn a Student under the age of 13 has provided us Personal Information beyond what is requested in connection with the Services, we will delete that information. If you believe that a Student under the age of 13 may have provided us Personal Information in violation of this Privacy Policy, please contact us at privacy@sowntogrow.com or by using our additional contact information in the "How to Contact Us" section at the end of this Privacy Policy. Parents and Students may, at any time, make a request to access, review, correct, delete, or decline to allow any further collection or use of, Personal Information in the Services by contacting the Student's applicable Institution.
If you are accessing the Services on behalf of an Institution, you agree and acknowledge that you have received from us notice of our information practices and that you consent, on behalf of the applicable Students, to the collection of Personal Information from Students under the age of 13 in accordance with the terms of this Privacy Policy. If you are a Teacher, you represent and warrant that you have permission and authorization from your Institution to use the Services as part of your curriculum.
In addition, we collect some non-personal information from Students who use our Service. For example, when Students use their Accounts to track their results on learning activities assigned by their Teachers, we will collect the student scores submitted for each activity. Our Service also may store information about Students' progress on academic or social-emotional indicators based on the setup of their Institution's implementation of the Service.
Student information is used, processed, and disclosed only:
- to provide Students and their schools or other applicable Institutions with the Services requested from Sown To Grow; or
- as de-identified, anonymized, and aggregated data.
This privacy policy does not govern any school's collection, use, or disclosure of personal information through the Site or Service, and we are not responsible for any such collection, use, or disclosure. Parents, please contact your child's school to understand the school's privacy practices.
Information Collected Through Technology for All Users.
Like most websites, we may use automatic data collection technology when you visit the Site with respect to information that identifies your computer and your use of our Site, in all cases solely in furtherance of providing the Services. This information may include information about your operating system, your IP addresses, browser type and language, referring and exit pages and URLs, date and time, amount of time spent on particular pages, what sections of a website you visit, and similar information concerning your use of the Site and the Services (the "Usage Information").
To the extent we collect this Usage Information, we may do so by using tools such as browser local storage, cookies or similar technology, and in all cases solely in furtherance of providing the Services, not for any advertising, marketing, or any other commercial purpose. We do not sell any such information.
Browser local storage is a tool that we use to identify you as a user and the fact that you are logged in so that we can customize your user experience. Similarly, cookies are small packets of data that a website stores on your computer's hard drive so that your computer will "remember" information about your visit. To the extent that the Site or the Services use cookies, you may be able to reject them by following the directions provided by your Internet provider. If you reject cookies, you may still visit the Site, but may not be able to use some areas of the Site or the Services.
We do not track you or collect your information across third-party websites.
How We Use and Share Your Information.
We use your Personal Information and Usage Information for providing you with the core aspects of the Service — namely, to provide you with the Software and its functionality — and in a manner that is consistent with this Privacy Policy and the context of our relationship with you.
More specifically, we will use your Personal Information and Usage Information collected through the Site for the following purposes:
- To respond to your requests and to provide you with the Services;
- To respond to your inquiries and contact you about changes to the Site and/or the Services;
- To send you notices (for example, in the form of emails, mailings, and the like) regarding products or services you are receiving, and for billing and collection purposes if you are an Institution;
- For any other purposes disclosed at the time the information is collected or to which you consent; and
- As otherwise specifically described in this Privacy Policy.
We may also use your information to improve our Site and/or the Services and may use tools such as browser local storage or cookies, as described above, to enable us to customize your user experience.
If you are a Student, your Teacher will have access to view your results on learning activities specifically assigned by that Teacher.
Sown To Grow may do research on our users' demographics, interests, and behavior based on the information provided to us upon registration, from our server log files, or from surveys. We do this to better understand and serve our users; for instance, this information often gives us ideas for improving the Services. This research is compiled and analyzed on a de-identified and aggregated basis.
We do not sell your Personal Information or Usage Information.
Our Personnel and Vendors.
To be able to effectively provide you with the Service, and to improve the functionality of the Service, we may disclose your Personal Information to our employees, contractors, agents, vendors, and other similar persons or entities to the extent that such persons or entities have a need-to-know such Personal Information in furtherance of the Service and are bound by confidentiality obligations with respect to such information. Our third-party vendors ("Third-Party Vendors") provide us with various types of services, including without limitation, hosting services, payment services, communications services, and customer support services.
Sale of Company or Assets.
If all or substantially all of our assets are acquired, we expect that the information that we have collected, including Personal Information, would be transferred along with our other business assets, upon reasonable notice to your school or other applicable Institution.
Responding to Government Requests.
We may disclose your Personal Information and Usage Information to government authorities, and to other third parties when compelled to do so by government authorities, at our discretion, or otherwise as required by law, including but not limited to in response to court orders and subpoenas. In handling such government requests, we greatly value the privacy of Personal Information. While we may be required to turn over user information at times, we will do so in compliance with any agreements we have in place with your school or other applicable Institution and, to the extent permitted by applicable law, will strive to notify your school or other applicable Institution when we receive government requests about your Personal Information. We also may disclose your Personal Information and Usage Information when we have reason to believe that someone is or may be causing injury to or interference with our rights or property, other users of this Site, or anyone else that could be harmed by such activities.
Researchers.
In addition, we may share your Personal Information with third-party researchers, subject to approval from the applicable local education agency with appropriate jurisdiction and a separate data agreement entered into prior to such disclosure.
How We Use and Share Your Information.
Duration of Storage of Personal Information.
We will store your Personal Information for as long as it is needed to provide the Service or until you or your Institution, as applicable, requests its deletion. We may not know if you have stopped using the Service, so we encourage you to contact us or your applicable Institution if you are no longer using the Service and would like to request deletion of your Personal Information. If required by applicable law, we may retain your Personal Information for such period as may be required by such law.
Security.
Sown To Grow takes reasonable steps to help protect your Personal Information in an effort to prevent loss, misuse, and unauthorized access, disclosure, alteration, and destruction. In addition, we rely on the technical safeguards provided by the Third-Party Vendors we use to host, store, and process your Personal Information. However, you acknowledge and agree that loss, misuse, and alteration may occur despite our efforts to protect your Personal Information. Although we will exercise reasonable care in protecting your Personal Information, no company can fully prevent security risks, and we expressly disclaim liability with respect to the security of your Personal Information.
Accessing, Modifying, and Deleting Account Information.
We strive to help parents ensure that their Students have a safe experience using our Services.
Parents. Parents can review any Personal Information collected about their Students who are under 13 years of age, have this information deleted, and/or request that there be no further collection or use of their Personal Information by contacting their Students' applicable Institution. In the event that we are contacted by anyone requesting information about a Student, we, in consultation with the Student's Institution, take reasonable steps to verify that person's identity as the Student's parent or legal guardian.
Students. In addition, Students can modify or delete information in their Account directly. If Students wish to delete their Accounts in their entirety, they should submit that request through their Teacher or applicable Institution.
Teachers. Teachers can delete their own Accounts directly and the information in their Accounts will be deleted in their entirety 30 days thereafter. Within that 30-day window, Teachers can request Account restoration by emailing us at privacy@sowntogrow.com.
Institutions. Schools or other applicable Institutions can request deletions of Accounts associated with their Institutions after the termination of a Contract by emailing us as well.
Important Notice to Non-U.S. Residents.
The Site and the Services are operated in the United States and are intended to be used only by residents of the United States. If you are located outside of the United States, please be aware that any information you provide to us will be transferred to the United States. By providing us with any information through the Site or the Services, you consent to this transfer of information to us.
California Privacy Rights.
In accordance with California Civil Code Section 1789.3, California resident users are entitled to know that they may file grievances and complaints with California Department of Consumer Affairs, Consumer Information Center, 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834; or by phone at 916-445-1254 or 800-952-5210; or by email to dca@dca.ca.gov. Changes to This Privacy Policy.
This Privacy Policy is effective as of the date stated at the top of this Privacy Policy. We may change this Privacy Policy from time to time and will post any changes on the Site as soon as they go into effect. If you don't agree with such changes, you must discontinue any further use of the Site or Service. By accessing the Site or using the Services after we make any such changes to this Privacy Policy, you are deemed to have accepted such changes. Please refer back to this Privacy Policy on a regular basis.
